Terms of service

These Terms of Service govern your use of `shop.thepitkw.com` and purchases from THE PIT / The Pit Box Co. – Kuwait (“THE PIT”, “we”, “us” or “our”). By using the store or placing an order, you agree to these terms. These terms do not exclude or limit rights that cannot lawfully be excluded under Kuwait law.

1. Store use
You must use the store lawfully and provide accurate, current information when placing an order. If you create an account, you are responsible for protecting its credentials and for activity carried out through it. You must not interfere with the store, attempt unauthorised access, misuse content, or use the store for fraudulent activity.

2. Products, descriptions and collector items
THE PIT sells Formula 1-related apparel, headwear, models, books, print media, accessories, genuine parts, and collector items. Product images, descriptions and availability are presented in good faith. Exact-photo one-of-one cards and collectibles are listed to identify the specific item offered; normal differences in screen colour, display, packaging, age, provenance materials or condition disclosure should be read with the full product listing.

Where a listing is expressly described as signed, numbered, one-of-one, limited edition, authenticated, race-used, made-to-order or personalised, it may be subject to the return treatment stated in the Return and Refund Policy. This does not remove a remedy that applies where an item is defective, materially not as described, or otherwise non-conforming.

3. Pricing and availability
Prices are displayed in Kuwaiti Dinar (KWD) unless stated otherwise. We try to keep all prices, availability and product information accurate, but errors can occur. If a material error is identified after an order is placed, we may contact you to confirm the corrected information or cancel and refund the affected order where appropriate.

Product availability is not guaranteed until an order is accepted and paid in accordance with the checkout process. We may limit quantities where reasonably necessary, including for scarce or collector goods, provided this does not conflict with applicable law.

4. Orders and payment
Submitting an order is an offer to buy. We accept an order when we confirm acceptance or dispatch, subject to payment authorisation, fraud screening, availability and applicable law. We may decline or cancel an order where there is a genuine pricing error, inability to fulfil, suspected fraud, legal restriction, or another lawful reason. Any applicable refund will be handled in accordance with our Return and Refund Policy and applicable law.

5. Delivery
Shipping and delivery are governed by our Shipping Policy. Delivery dates are estimates unless we expressly agree otherwise. You are responsible for providing a complete and accurate delivery address and, for international deliveries, any applicable import duties, taxes or clearance requirements unless the checkout expressly states that these are included.

6. Promotions and bonuses
Promotions, including the qualifying-order card bonus, are subject to the published offer terms, availability and reasonable anti-fraud controls. Promotional items are selected from available stock as described in the offer and have no cash value unless mandatory law requires otherwise.

7. Intellectual property
THE PIT name, standalone P mark, website design, text, graphics and other proprietary store content are owned by or licensed to THE PIT and may not be copied, reproduced, modified, distributed or used commercially without prior written permission. Third-party names, team marks and product names remain the property of their respective owners and are used only to identify the relevant products.

8. Liability and mandatory rights
Nothing in these terms excludes liability or a consumer right that cannot lawfully be excluded. To the maximum extent permitted by law, THE PIT is not responsible for indirect, incidental or consequential loss arising from use of the store. This does not limit rights relating to defective, unsafe, incorrectly supplied or non-conforming goods where applicable law provides a remedy.

9. Governing law and disputes
These terms are governed by the laws of the State of Kuwait. Before starting formal proceedings, please contact info@thepitkw.com so we can try to resolve the issue. This clause does not prevent you from using any consumer-protection complaint route or mandatory legal remedy available to you.

10. Changes to these terms
We may update these terms for operational, legal or regulatory reasons. The version in force when you place an order will apply to that order unless a change is required by law.
